By downloading and using the Les Copains application, you agree to these Terms of Use. Please read them carefully before using the service.

In accordance with Article 6-III of the French Act on confidence in the digital economy (LCEN), as the publisher is a non-professional private individual, their postal address is not made public; their identity is held available to the host and the competent authorities.

Use of the Les Copains mobile application (hereinafter "the Application") implies full and unconditional acceptance of these Terms of Use. If you do not accept these terms, you must stop using the Application and uninstall it.
These Terms may be amended. In the event of a substantial change, you will be notified via the Application with reasonable prior notice before it takes effect. Your continued use of the Application after this notice period constitutes acceptance of the new Terms. If you do not accept the new Terms, you may delete your account free of charge at any time from the Application's Settings.
Les Copains is a mobile application (iOS and Android) that allows you to:
The service is provided free of charge, with no financial consideration or transaction. No paid features are planned. Should such a change ever be considered in the future, these Terms would be updated accordingly, subject to the prior notice provided for in Article 1.
Registration is open to anyone aged at least 15 years old, in accordance with the age of digital consent applicable in France. By registering, you confirm that you are at least 15 years old.

You are solely responsible for all activity carried out from your account.
You agree to use the Application in a lawful, respectful manner consistent with these Terms. The following are strictly prohibited:

Any breach may result in the suspension or permanent deletion of your account, without prejudice to any legal proceedings.
The Application allows you to post content (dog photos, spot photos, chat messages, community alerts). By posting this content, you:
This licence ends when you delete your content or your account, subject to the retention periods set out in our Privacy Policy. However, residual copies may temporarily remain in technical backups, until their normal rotation, as well as in community content already redistributed or incorporated by other users (for example a chat message already received). The end of the licence cannot therefore be instantaneous in all contexts.
Image rights. If your content includes identifiable individuals, you warrant that you have obtained the necessary permissions from those individuals (or their legal representatives) for publication. Any identifiable individual may request the removal of content concerning them by writing to copainsapp@gmail.com; Les Copains will carry out the removal as promptly as possible.
Your content is not used to train artificial intelligence models.
You retain full intellectual property rights over your content. Les Copains claims no ownership over content you post.
The Application allows an owner to invite one or more co-owners to share the management of a dog.
The Application, its design, source code, logos, trademarks, text and all graphic elements are the exclusive property of Les Copains and are protected by French and international intellectual property law.
Any reproduction, representation, modification, publication or adaptation of all or part of the Application, without prior written authorisation from Les Copains, is strictly prohibited.
Les Copains grants you a personal, non-exclusive, non-transferable and revocable licence to use the Application for strictly personal and non-commercial purposes.
Important points regarding walks:
Les Copains shall not be held liable for any indirect damage, data loss, service interruption, or harm resulting from the use of or inability to use the Application.
In the event of a technical malfunction, data may be temporarily unavailable. Les Copains strives to maintain maximum availability but does not guarantee uninterrupted service.
The limitations of liability above do not apply in the event of personal injury, of gross negligence or wilful misconduct by the publisher, nor in cases where the law prohibits such a limitation (in particular Article R. 212-1, 6° of the French Consumer Code and Article 1170 of the French Civil Code, which deems unwritten any clause depriving the debtor's essential obligation of its substance).
If you encounter content or behaviour that violates these Terms, you can report it via the in-app reporting feature or by email at copainsapp@gmail.com.
Les Copains commits to handling reports as promptly as possible and taking appropriate action.
Les Copains reserves the right to suspend or delete any account:
In the event of suspension for a Terms violation, you will be notified by email. You may contest the decision by contacting copainsapp@gmail.com within 14 days.
You may delete your account at any time from the Application's Settings. Deletion results in the erasure of your personal data within the timeframes set out in our Privacy Policy.
Les Copains is an independent application provided free of charge. We strive to keep the service available but do not guarantee:
Les Copains may evolve, modify or discontinue all or part of the service. Any substantial change to the service or to these Terms is subject to reasonable prior notice, communicated via the Application. If you do not accept these changes, you may delete your account free of charge at any time from the Application's Settings. In the event of definitive discontinuation, you will be informed with a minimum notice of 30 days by email and via the Application, so that you may retrieve your data.
These Terms are governed by French law. In the event of a dispute relating to the interpretation or performance of these Terms, the parties shall endeavour to reach an amicable resolution, in particular by contacting copainsapp@gmail.com.
Failing an amicable resolution, the consumer may, at their choice, bring the matter before one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or the court of the place where they resided at the time the contract was concluded or the harmful event occurred (Article R. 631-3 of the French Consumer Code).
The Application is provided free of charge by a non-professional private individual; accordingly, the consumer mediation scheme is not intended to apply.
These Terms are drafted in French and translated into English for convenience. In the event of any discrepancy in interpretation between the two versions, the French version shall prevail.
If any provision of these Terms is found to be null or unenforceable, the remaining provisions shall remain valid and enforceable. The failure of Les Copains to enforce any provision of the Terms shall not constitute a waiver of that provision.
